Peterborough Regional Health Centre (PRHC) Privacy Breach Class Action [H1] 

Spiteri and Ursulak LLP has commenced a proposed class action against the hospital Peterborough Regional Health Centre (PRHC) and other defendants for breaches of patient privacy that occurred between 2011 and early 2012.

Between 2011 and early 2012, former employees of PRHC used the hospital database to inappropriately access the personal information of approximately 280 patients.

Supreme Court Decision Permits Proposed Class Action to Proceed

On October 29, 2015, the Supreme Court of Canada dismissed the defendants’ appeal of a decision in which the Ontario Court of Appeal ruled that patients should be permitted to sue hospitals and staff members for privacy breaches and not simply be restricted to making a complaint to the Information and Privacy Commissioner.
